  • 2. Acceptance of Terms

By accessing or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, you must cease using the Services. Users under 18 require legal guardian consent.

3. Dietary Supplements & Health Disclaimer

  • Regulatory Compliance: Our products are notified in Spain according to RD 1487/2009.
  • Non-Medicinal: Supplements are not medicines and do not replace a balanced diet or professional medical advice.
  • Usage: Do not exceed the recommended daily dose. Keep out of reach of children.

4. Accounts and Information

You agree to provide true, accurate, and complete information for billing and shipping. You are responsible for maintaining the confidentiality of your account credentials.

5. Orders and Availability

  • Formation of Contract: Your order is an offer to buy. We accept it only when we send a shipping confirmation email.
  • Limitations: We reserve the right to limit quantities per person or order and to discontinue products without notice.
  • Resale: Purchases are for personal use only; commercial resale is prohibited unless authorized in writing.

6. Prices, Taxes, and Billing

  • VAT: Prices include Spanish VAT unless stated otherwise.
  • B2B: EU business customers must provide a valid VIES VAT ID for Reverse Charge treatment.
  • Payment: You confirm you are authorized to use the selected payment method.

7. Shipping and Delivery

  • Estimates: Delivery times are estimates. VIVID is not liable for carrier or customs delays.
  • Risk: Title and risk pass to you upon delivery of the goods to the carrier (or physical possession for consumers).
  • Damage: Inspect packages upon arrival. Report transport damage within 48 hours.

8. EU Right of Withdrawal (Returns)

  • Withdrawal Period: Consumers have 14 calendar days from delivery to withdraw.
  • Exclusions (Hygiene): Per Spanish Consumer Law (Art. 103.e), the right of withdrawal does not apply to sealed goods that are not suitable for return for health or hygiene reasons if they are unsealed after delivery (e.g., opened supplement tins).
  • Refunds: Returns of sealed, intact products will be refunded via the original payment method, excluding return shipping costs.

9. Intellectual Property

All content, trademarks (VIVID), and designs are owned by VIVID RECOVERY, S.L. or its licensors. Unauthorized reproduction is prohibited.

10. Liability and Warranties

  • "As Is": Services and products are provided without express or implied warranties beyond those required by law.
  • Cap: To the extent permitted by law, VIVID’s liability is limited to the amount paid for the product in question.

11. Governing Law and Disputes

  • Jurisdiction: These Terms are governed by Spanish law. Non-consumer disputes will be settled in the courts of Madrid.
  • Online Dispute Resolution: Consumers may access the EU ODR platform at: https://ec.europa.eu/consumers/odr.
